This data shows the path route of an application for a modification order which requests that the council make an order to record the claimed route on the definitive map and statement. It can be viewed alongside the Public Rights of Way layer, and allows the Council or Public to check if a route is public or currently subject to a claim. Statutory basis: Under Schedule 14 of the Wildlife and Countryside Act 1981 anyone may make an application to a Council “claiming” that a route is public right of way. The applicant requests that the Council should make (and confirm) a Modification Order to add the claimed route to its definitive map and statement, which is the legal record of public rights of way. These applications are supported by evidence of public use and / or documentary evidence such as old maps, books and / or other material. |
